                   AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS
                   AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS
                   TO REZONE A TRACT OF LAND LOCATED AT 1303
                   HIXSON PIKE, BEING ON THE NORTHWEST LINE OF
                   HIXSON PIKE AT DARTMOUTH STREET, FROM O-1
                   OFFICE ZONE TO C-5 NEIGHBORHOOD COMMERCIAL
                   ZONE, SUBJECT TO CERTAIN CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as
         amended, known as the Zoning Ordinance, be and the same is 
hereby
         amended so as to rezone:
               
                A tract of land located at 1303 Hixson Pike, being
                on the northwest line of Hixson Pike at Dartmouth
                Street.  Part of lot 1, block 1, Chattanooga
                Estates Company Highlands Subdivision, as shown by
                plat of record in plat book 6, page 29, ROHC; being
                the property described as Tract 3 in deed book
                3785, page 928, ROHC.  Tax Map No. 127P-L-20.
               
         from O-1 Office Zone to C-5 Neighborhood Commercial Zone.
        
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this rezoning 

         shall be subject to the following conditions:
        
              1.   Use for offices and deli take-out only, with no 
on-site
                   consumption; and
        
              2.   All existing easements are retained.
        
        
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage, as
         required by law.
